56.3 Involuntary Hospitalization Process Map
District Court
KRS 202A
Involuntary hospitalization proceedings include the hospitalization of adults
diagnosed with a mental illness. KRS 202A.012. For mental health procedures
involving juveniles, follow procedures outlined in the Juvenile Mental Health
section.

56.3.1 Confidentiality of Records
1. All involuntary hospitalization proceedings and records are confidential. Quick Reference
KRS 202A.091(1).
• They are open to the respondent and the county attorney when
assisting the petitioner. 202A.016.
• A court order is required for other individuals seeking access to
the case file. KRS 202A.091(3).
• The respondent can move after discharge or denial of admission
to have court records expunged on notice to the county
attorney. KRS 202A.091(2).
2. If you receive a citation, which is NOT attached to a petition, charging a UOR Code 030040
person with UOR Code 030040, 60/360 Day Involuntary UOR Code 030050
UOR Code 030080
Hospitalization of Mentally Ill Person; or UOR Code 030050,
Emergency Detention; or UOR Code 030080, Involuntary
Commitment of Individual with Alleged Intellectual Disabilities, do not
open a case file. Retain the citation by stapling it to the officer’s
transmittal list submitted with the citation. If the citation is attached to
a petition, open the case file based on the petition and retain the citation
in the case file. Do not complete a charge screen for any UOR listed
AOC Form 712
herein.
3. If you receive an AOC Form 712, Certification of Qualified Mental Health
Professional, and no AOC Form 710, Verified Petition, proceed to 72 AOC Form 710
Hour Hospitalization.
4. If you receive an AOC Form 710, Verified Petition, proceed to 60/360 Day
Not Filed by QMHP.
