PENALTIES FOR VIOLATIONS OF SEWER USE REGULATIONS

Penalties for violations of this Bylaw and any regulations enacted pursuant thereto shall be in
accordance with the procedures and in the amounts set forth in regulations enacted in accordance
with this Bylaw.
   A. The purpose of this bylaw is to establish a procedure for the adoption of rules and
        regulations, fees and charges, and penalties related to connections to and use of the Town
        of Amherst public sewer system.
   B. The Town Council, acting as the Sewer Commission in accordance with Section 2.14 of
        the Charter, and pursuant to M.G.L. c. 83, §§ 1, 10, is authorized to promulgate and
        amend regulations and set penalties for violations of such regulations to ensure that the
        Town of Amherst public sewer system and all connections to it have the required
        technical, managerial, and financial resources for complying with the Federal Clean
        Water Act 33 USC §1251 et seq. and the Massachusetts Surface Water Quality Standards
        314 CMR et seq., and all applicable federal and state laws, regulations, and permit
        requirements relative to the sewer system. Nothing in this bylaw is intended to or shall
        replace any statutory or regulatory permitting, testing, or operating requirements
        applicable to sanitary sewer systems.
