The district court determined Winter’s conduct was not sufficiently reprehensible to justify the jury’s punitive damages award. The district court may have based this finding on an assumption the jury considered Winter’s conduct toward other tenants, and not just the conduct directed toward Quigley, in arriving at the punitive damages amount. However, as Quigley notes, the jury instruction on punitive damages clearly stated the jury was to consider “[Winter]s conduct only as against [Quigley]” in assessing punitive damages. We have no reason to believe the jury disregarded the district court’s instructions.
