​ (6)​ A variance may be issued for new construction, substantial improvements or
other development for the conduct of a functionally dependent use only if
the other criteria of Sec. 5-141(1-5) and Sec. 5-132 are met and, the
development is protected by methods that minimize flood damage during the
base flood and create no additional threats to public safety.

​ (7)​ A variance may be granted for the repair, reconstruction, rehabilitation,
or restoration of historic structures upon a determination that the
development meets the criteria of Sec. 5–143(a)(1-6) and the proposed
repair, reconstruction, rehabilitation, or restoration will not preclude
the structure’s continued designation as an historic structure and the
variance is the minimum necessary to preserve the historic character and
design of the structure.

(8)​ ​ A variance may be granted for new construction and substantial improvement
of agricultural structures being used for the conduct of agricultural uses
only if the other criteria of Sec. 5-131(7), Sec. 5-132, and Sec. 5-143(1)
are met, and the development is protected by methods that minimize flood
damage during base flood and create no additional threats to public safety.

(b)​ Any applicant who meets the criteria of Sec. 5-143(1-5) and Sec. 143(6), (7), or
(8) shall be notified by the Board of Appeals in writing over the signature of
the chairman of the board that:

​ (1)​ she issuance of a variance to construct a structure below the base flood
level will result in greatly increased premium rates for flood insurance up
to amounts as high as $25 per $100 of insurance coverage;

​ (2)​ such construction below the base flood level increases risks to life and
property; and,
