(5)​ Preventing or regulating the construction of flood barriers which will
unnaturally divert flood waters or which may increase flood hazards in other
areas.

Sec. 5-105.​ Applicability; Effective Date of Certain Amendments.

​ This article applies to all land areas and development lying in the Areas of
Special Flood Hazard for the City of South Portland, Cumberland County, Maine, Zones A,
AE, and VE, as identified by the Federal Emergency Management Agency in a report
entitled "Flood Insurance Study: Cumberland County, Maine (All Jurisdictions)”, (FIS),
dated June 20, 2024 with accompanying "Flood Insurance Rate Map" (FIRM) of the city
dated June 20, 2024, as amended by subsequent Letter of Map Change actions (LOMCs),
both of which are adopted by reference and declared to be a part of this Code. The
amendments to this article evidenced by ORDINANCE #20-23/24, when enacted, shall become
effective on June 20, 2024.

Sec. 5-106.​ Definitions.

​ Unless specifically defined below, words and phrases used in this article shall
have the same meaning as they have at common law and to give this article its most
reasonable application. Words used in the present tense include the future, the
singular number includes the plural, and the plural number includes the singular. The
word "may" is permissive; "shall" is mandatory and not discretionary.

​ Accessory structure. A structure that is on the same parcel of property as a
principal structure and the use of which is incidental and subordinate to the principal
structure.
