(5) Any proposed development plan must include a condition of plan approval requiring
that structures on any lot in the development having any portion of its land within
a Special Flood Hazard Area are to be constructed in accordance with Sec. 5-131.
Such requirements must be included in any deed, lease, purchase and sale agreement,
or document transferring or expressing intent to transfer any interest in real
estate or a structure, including, but not limited to, a time-share interest. The
condition shall clearly articulate that the city may enforce any violation of the
construction requirement and that fact shall also be included in the deed or any
document previously described. The construction requirements shall also be clearly
stated on any map, plat, or plan to be signed by the Planning Board as part of the
approval process.

Sec. 5-113. Conditional use review.

​ The Planning Board shall hear and decide applications for conditional uses as
provided for in this article. The Planning Board shall hear and approve, approve with
conditions, or deny all applications for conditional uses. An applicant for a Flood
Hazard Development Permit informed by the Code Enforcement Officer that conditional use
review and approval is required shall first file an application for Planning Board
conditional use approval with the Planning Board.

(a)​ The review procedure for Planning Board conditional use approval shall be as
follows:

(1)​ The Flood Hazard Development Permit application, along with additional
information attached addressing how each of the conditional use criteria
specified in this article, may serve as the permit application for the
conditional use approval.
