The referee did not find that the plaintiffs withholding of or failure to return Schwartz’ personal items was a mere inconvenience, or that Schwartz’ property that was not returned to him, or was unreasonably delayed in being returned to him, equated to minimal personal effects. This argument, therefore, is not based on nor supported by any facts in the record.
