Ed. 2d 686 (1994), decided eleven years after Connick, the court was confronted with the question of “whether the Connick test should be applied to what the government employer thought was said, or to what the trier of fact ultimately determines to have been said.” The case involved the public employer’s reliance, in discharging the employee, on reports of certain statements purportedly made by the employee at work during a dinner break.
