(d) A Landlord may obtain the signature of a Tenant by electronic signature
as though the notice were related to a “transaction” as defined in 10 M.R.S.
§ 9402(11), as may be amended from time to time, if the Landlord and that
Tenant have agreed to conduct transactions by electronic means as provided
in 10 M.R.S. § 9405(2), as may be amended from time to time. The Landlord
shall retain the original, or a physical or – to the extent provided in 10
M.R.S. § 9412(1) - electronic, copy of the notice, acknowledgement, receipt
and/or certificate set forth in subsection (b)(i)-(iii) for a period of six
(6) years from the date of such, and shall make any such original or copy
available for inspection at the request of the City of South Portland.

Sec. 12-224. Tenant and Landlord rights and responsibilities.

(a) The City Manager or his/her designee shall create and make available on the
City’s publically accessible web site a plain language document that explains
tenancy at will and the rights and responsibilities of Tenants and Landlords of
rental dwelling units. That document shall also include a checklist of required
notices concerning environmental lead hazards, energy efficiency or radon testing,
pursuant to 14 M.R.S. §§ 6030-B, 6030-C, and 6030-D, respectively, as amended
from time to time.
(b) The document referenced above shall be provided by Landlords to all Tenants in
the City of South Portland at the commencement of the rental of a dwelling unit. It

shall be the responsibility of the Landlord to ensure the most current version of
the document is provided when required.
