each Tenant as follows:
(i) By hand delivery directly to that Tenant, with that Tenant signing a
written acknowledgement of the date on which the notice was so delivered,
in which case the notice is considered to have been delivered to that
Tenant on the acknowledged delivery date;
(ii) Electronically as though the notice was related to a “transaction” as
defined in 10 M.R.S. § 9402(11), as may be amended from time to time, if
the Landlord and that Tenant have agreed to conduct that transaction by
electronic means as provided in 10 M.R.S. § 9405(2), as may be amended
from time to time, in which case the notice is considered to have been
delivered to that Tenant upon receipt as provided in 10 M.R.S. § 9415(2),
as may be amended from time to time; and
(iii) If the Landlord is unable to hand or, if otherwise permitted in
subsection (b)(ii), electronically, deliver the notice directly to a
Tenant as provided in subsection (b)(i) or (b)(ii) above after three or
more good faith attempts to do so on three separate days, or if the
Landlord is able to hand deliver the notice to a Tenant, but a Tenant
then refuses to sign a written acknowledgement of that Tenant’s receipt
of that notice, then the Landlord may deliver the notice to that Tenant
by mailing it by first class mail, postage prepaid, addressed to Tenant’s
last known mailing address, and obtaining a U.S. Postal Service
certificate of mailing for the same, in which case delivery of the notice
shall be shall be conclusively presumed to have been made on the third
calendar day after that mailing, or if that third day is not a day on
which the U.S. Postal Service would ordinarily deliver mail at the
Tenant’s last known mailing address, then on the next day when such a
delivery would be made in the ordinary course of
