It appears that the Harris courts treated “acquisition” in the “acquisition” clause and “acquiring agency” in the “notice” clause as functional equivalents, thus disposing of the majority’s attempt to distinguish this case. Maj. op. at 162 & n.29, of 187 U.S.App.D.C., at 596 of 571 F.2d. Not only did the Court of Appeals “adopt the factual statement and legal reasoning” of the District Court, but also specifically stated, “The plaintiffs’ eligibility for assistance, in essence, turned on the resolution of two issues: (1) whether there was an ‘acquisition’ for a program or project of a Federal Agency, and (2) whether the demolition was part of a comprehensive city demonstration program . . .” 555 F.2d at 1360. The majority’s efforts to distinguish Harris, like its efforts to distinguish Alexander, simply won’t wash. . 411 F.Supp. at 695. . Id.
