To prove fraud based on a misrepresentation, a plaintiff must show that the defendant knowingly made a false representation, intending the plaintiff to rely on it, and that the plaintiff was injured by his justifiable reliance on the misrepresentation. Tessier v. Rockefeller, 162 N.H. 324, 332, 33 A.3d 1118 (2011). Thus, to recover for fraud, a plaintiff must “reasonably rely [on a misrepresentation] to his detriment.” Snow v. Am. Morgan Horse Ass’n, Inc., 141 N.H. 467, 468, 686 A.2d 1168 (1996). Circumstances that support claims of fraud must be alleged with particularity. See Fed.R.Civ.P. 9(b).
