Sykes alleges that the mortgage defendants violated RESPA by failing to acknowledge receipt of, or otherwise respond to, Sykes’s inquiries concerning the additional $400 charge in November and December of 2008, and January of 2009, each of which he alleges were a qualified written request (“QWR”) under the statute. See 12 U.S.C. § 2605(e). The mortgage defendants contend that even assuming that Sykes alleged a claim for violation of RESPA, the claim is time-barred under RESPA’s three year statute of limitations.
