In his reply to the mortgage defendants’ objection, Sykes appears to concede that if the relevant date for purposes of the statutes of limitations for his various claims was the date of the mortgage defendants’ wrongful conduct, his claims would be time-barred. He argues, however, that he did not discover and should not have discovered the mortgage defendants’ wrongful conduct until April of 2011 and, therefore, none of his claims is time-barred. He further argues that the limitations periods should be tolled because (i) the mortgage defendants “fraudulently concealed” facts essential to his causes of action and (ii) he was incapacitated from the “shock from suddenly and inexplicably losing his home, income and family.” 1.
