“In every agreement, there is an implied covenant that the parties will act in good faith and fairly with one another.” Birch Broad. Inc. v. Capitol Broad. Corp., Inc., 161 N.H. 192, 198, 13 A.3d 224 (2010). As discussed above, the mortgage defendants’ arguments concerning the notices are not sufficient to show that they complied with the provisions of the mortgage agreement. The mortgage defendants make no other arguments as to the sufficiency of Sykes’s claim for breach of the implied covenant of good faith and fair dealing against them. Therefore, the amended complaint states such a claim.
