In the amended complaint, Sykes alleges that the mortgage defendants “violated the implied covenant of good faith and fair dealing by unreasonably failing to provide notices to the Plaintiff about his mortgage loan, to respond to Plaintiffs requests for information, to fix errors in his mortgage bills, and by offering loan modification for the first time in a letter that did not reach Plaintiff until after the foreclosure auction.” Compl. ¶ 208. The mortgage defendants argue that they provided Sykes with the notices of default, acceleration, and foreclosure that are attached to their objection and, therefore, did not breach the covenant.
