The guarantee presented to the defendants includes the following statement: “This agreement is not valid until approved and signed by the [department] [Regional [mjanager or the [sjhelter [d]irector.” It is undisputed that the guarantee was signed by Kenneth Smith, who was neither a regional manager nor a shelter director, who was authorized to do so by the regional manager of the department office in accordance with an apparent department policy. 12
