394 charssion, that the tenant necessarily retains that right in cases (like this) where the tenant sued. If this writing has any legal effect, we cannot see why it should persuade us to nullify a provision giving the landlord a whole loaf (no jury no matter who sues), merely because otherwise the half-loaf clause will be redundant. Chopping out the broader clause seems an odd response to an overlap.
