District law appears uncertain on these issues. A statute, D.C.Code § 16-1501 (1981), provides the landlord an action to recover possession, but only if he has a right to possession, which under the common law he would lack. See also 1 Restatement § 12.1, Statutory Note 1 at 399, 404-05 (listing § 16-1501 among statutes allowing recovery of possession only where the lease provides for a forfeiture); but compare D.C.Code § 45-2551(b) (1981) (evidently affording residential landlords a right to possession).
