431 chars. The District cannot (and does not) argue that the plaintiffs’ section 1983 claim is foreclosed by the fact that the District’s formal housing regulations are consistent with federal law. By its plain terms, section 1983 provides an express federal remedy for the deprivation of federal rights by state officials irrespective of whether the alleged deprivation is due to a state "statute, ordinance, regulation, custom, or usage."
