They argued that the District’s systematic and classwide failure to implement and maintain an administrative grievance procedure for complaints concerning the operation and maintenance of public housing projects violated their federal rights under the due process clause of the fifth amendment, under the Act and its accompanying regulations, and as third-party beneficiaries of the annual funding contract between the District and the federal government. 2 See id. ¶¶ 1, 47, 56, 66, J.A. at 2,12,14,16.
