[21] If a landlord in a notice case wants to prevent a jury trial for the McNeal phase, the landlord can forego a protective order. If we focus on strictly notice cases, it is difficult to understand why there would be a need for a protective order in any event, since presumably nonpayment of rent is not an issue. Moreover, as we pointed out in Part II of our original opinion, a landlord who sends a notice to quit may reserve the right to continue to receive rent without waiving the notice. At 7.
