As indicated earlier, both the Brown defense 4 and the recoupment defense based *16on Javins5 addressed only the landlord’s claim for nonpayment of rent. Both defenses lapsed with the landlord’s voluntary dismissal of that claim before the trial court heard the parties’ cross-motions for summary judgment on the landlord’s notice case. Moreover, as previously explained, the tenant’s retaliatory eviction defense, while applicable to a notice to quit, provides no basis for a rent abatement.
