In sum, we conclude that the tenant, upon timely written or oral notice of alleged code violations during the litigation period of a notice case, is entitled to a post-trial, evidentiary McNeal hearing on whether code violations during that period, but not before,13 justify an abatement under Javins of the rent (or portion thereof) paid into the court registry pending resolution of the landlord’s possessory action.14 IV.
