DANNEHY, J. In this summary process action, the
defendants, Frank J. Freccia III, Tammie Freccia, Lock-
sley Freccia, and Dartagnan Freccia,1 appeal from the
judgment of the Appellate Court affirming the trial

   In the interest of simplicity, we refer to each of the defendants indi-
vidually by first name when appropriate. Further, the defendants note
that Dartagnan’s name is misspelled in the complaint, reflected with an
apostrophe as “D’artagnan.” We use the proper spelling in this opinion,
as there is no ambiguity regarding the identity of the party being sued.
