First, when, a lease contains a clause specifically giving a landlord the right to re-enter the premises and re-let the property to mitigate tenant’s damages in the event of tenant’s default, such a clause constitutes a consent by the tenant to such re-entry, and prevents a landlord’s action from constituting an acceptance of surrender of the lease.
