While it is the function of courts to interpret rather than make the law, it must nevertheless be borne in mind that the common law is not a collection of archaic, abstract legal principles ...—it is a living system of law that, like the skin of a child, grows and develops as the customs, practices and necessities of the people it was adopted for change.
