511 charsNevertheless, the landlord contends that those issues are “in substance the same” as those raised below (“albeit through expanded and somewhat differently formulated arguments”) and points to four isolated phrases in the amended complaint as support for this contention. However, even if we construed the amended complaint as raising the issues now argued, the landlord not only failed to pursue those arguments but, in fact, took a contrary position in its *460 memorandum in opposition to summary judgment. 11
