In fact, the Ninth Circuit found that requiring property owners to enter into HAP contracts could “render essentially worthless an owner’s right to lawfully opt-out of its involvement in the Section 8 program" and “frustrate Congress’s clear intention in the 1996 amendments to the Act to end so-called ‘endless leases,’ under which owners could not refuse to renew the leases of Section 8 tenants at the conclusion of a lease term.” Park Vill., 636 F.3d at 1161-62. The same reasoning applies here. Requiring property owners to continuously renew rental agreements would render their opt-out "essentially worthless.”
