by which a housing provider may take advantage of a "rebuttable presumption” of substantial compliance with the housing code: (i) if the housing accommodation "was last inspected for housing code violations more than thirty (30) days prior to the date of filing of the petition for adjustment, and all substantial violations then cited have been abated within the time set forth in the notice of violations,” 14 DCMR § 4216.3(a); or (ii) if the housing accommodation "shall have been inspected at the housing provider’s request within thirty (30) days immediately preceding the date of filing of the petition for adjustment.” 14 DCMR § 4216.3(b).
