The owner of the premises, Fryer, had died on May 24, 2011, and the plaintiff Sullivan was appointed representative of the estate. Because of financial hardship, the plaintiff moved the Probate Court to appoint someone else to be the representative. On August 16, 2011, the Probate Court appointed attorney Christopher J. Donlin as the administrator of Fryer’s estate. The plaintiffs attorney then moved to have Donlin substituted as the plaintiff, which motion the court granted over the defendants’ objection.
