The defendants specifically argue that the court erred in denying their request for subpoenas and in denying their “motion for a kangaroo mistrial and . . . motion [to] dismiss with prejudice . . . .” On May 12, 2010, the defendants filed a “motion for a kangaroo mistrial [and] motion to dismiss with prejudice” in which they argued that the court improperly had denied their requests for material witnesses and denied their right to a fair trial.
