5. Conclusion. So much of the order of the Superior Court granting the defendant's motion for summary judgment on the plaintiffs' claim pursuant to G.L.c. 121B, §§ 32C and 32D, and the claim for breach of the covenant of quiet enjoyment, is vacated and the judgment is reversed. The remainder of the order, granting summary judgment on the claim for breach of the warranty of habitability and the claim for nuisance, is affirmed. The case is remanded to the Superior Court for further proceedings in accordance with this opinion. So ordered. LYNCH, J. (dissenting in part).
