In their complaint, the plaintiffs asserted a cause of action under the United States Housing Act, 42 U.S.C. § 1437 (1988). The plaintiffs failed to argue this claim in their brief and, in their reply brief, expressly waived “any claims based upon a federal cause of action in warranty of habitability or quiet enjoyment.” Accordingly, we do not address the Federal claim.
