*279Summary judgment may be granted only when the moving party demonstrates that there is no genuine issue as to any material fact and that the movant is entitled to judgment as a matter of law. Mass. R. Civ. P. 56 (c). Flesner v. Technical Communications Corp., 410 Mass. 805, 808-809 (1991). The defendant did not meet this burden as to the plaintiffs’ claim under G. L. c. 121B, § 32D, since there are genuine issues of fact remaining.
