On April 8, 1993, the trial court granted respondents’ summary judgment motion.The Board’s motion for reconsideration was denied, and on May 28, 1993, judgment was granted, permanently enjoining the Board from enforcing Regulation No. 4005, subdivision (a)(8). The trial court concluded that the regulation “cannot be reconciled with the constitutional standard articulated in [Birkenfeld] and [Vega].” Discussion 1.
