Apparently the appellate panel below assumed that Donn, Olga and David are a
single family unit that is easily distinguishable from Nancy. Thus, the court reasoned that
if the total relocation payment was divided among all four occupants of the unit rather
than the three adults, the total payment to the family would have been $650 higher, and
the net payment to Nancy concomitantly lower. Plaintiff and amicus curie, San Francisco
Apartment Association, point out the logistical problems of requiring landlords to make
this type of assumption about the composition of a family unit.
