An identical conflict would exist if a landlord sought to terminate a tenancy under Civil Code section 1946, instead of Code of Civil Procedure section 1161, in retaliation for the tenant’s exercise of statutory rights. Section 1946 authorizes either party to a month-to-month tenancy to terminate on 30 days’ written notice.
