former wife sued the pharmacy that unlawfully provided her former husband with private medical information about her that he used in their dissolution action. (Ibid.) The court held the pharmacy could not take advantage of the litigation privilege shielding the ex-husband’s use and communication of that information in the dissolution because the pharmacy was sued for its own tortious behavior in providing the information to the ex-husband, it was neither a litigant nor a participant in the action, and it did not provide the information in order to further the object of the litigation.
