397 chars. Even though the "one strike” policy was implemented eight years after the passage of § 1437d(Z)(6) it still may offer a legitimate rationale for the passage of the statute. Atonio v. Wards Cove Packing Co., 10 F.3d 1485, 1494 (9th Cir.1993) ("A rational basis need not be one that actually motivated Congress. It is enough that plausible reasons for Congress’ action exist.” [citations omitted])
