Even counsel for Diamond seems to have conceded that a jury would find the landlord to have been motivated by retaliatory purposes. At one point in oral argument he stated, "Any jury is going to have to practically say that there is retaliation. Certainly, it's understandable-only human nature, that a person who can't collect the rent is going to try and get them out. That's going to be the basic reason."
