It is clear, then, that whether the landlord is unable to repair the premises or simply unwilling, the policy of Section 2301 can be respected without authorizing evictions which violate Southall Realty, Edwards, and the housing code itself. We must keep constantly in mind that the purpose of the housing code is to increase rather than decrease the stock of habitable housing in the District of Columbia. Given this purpose, it would be surprising indeed if the code blocked development of fair and effective weapons to fight the mounting housing crisis. D. Mootness.
