¶33 Whether the defendant owed a duty to the plaintiff is a question of law. Hertog, 138 Wn.2d at 275. There are three distinct theories on which a tenant may base a claim for personal injuries: the landlord’s breach of a duty under (1) the rental agreement,4 (2) the common law, or (3) the RLTA.
