c. An Owner may request the enforcing authority remove the Nuisance Property
designation if the Property has not received a violation in the six months following
the approval by the Town of the Corrective Action Plan. Removal of the designation
is at the discretion of the enforcing authority.

H. Failure to Correct
1. Failure to implement the Corrective Action Plan within the timeframe is a separate
violation and may result in additional penalties.

2. Failure to contact the enforcing authority, schedule a meeting, or submit a Corrective
Action Plan within the required timeframes of this Bylaw is a separate violation and may
result in additional penalties.

3. A rental property that is designated a nuisance property two years in a row shall be at risk
of losing the rental permit as well as more frequent inspections as required under General
Bylaw 3.50 regulations.

I. State Law Not Preempted.
1. This Bylaw shall not limit the authority of police officers to make arrests for any criminal
offense arising out of conduct regulated by this Bylaw, nor shall this Bylaw limit the
Town’s or the Commonwealth’s authority to initiate and prosecute a criminal offense
arising out of the same circumstances necessitating the application of this Bylaw.

2. No provision of this Bylaw shall apply where prohibited or preempted by the law of the
Commonwealth or federal law.
