1. For a Property receiving the first or second notice of violation in a 1-year period:
a. The Person(s) who organized or sponsored an activity that resulted in a Public
Nuisance; and/or,
b. Persons engaging in activity resulting in a Public Nuisance.
2. For a Property receiving the third or subsequent notice of violation in a 1-year period and
having been notified of the first and second violation:
a. The Person(s) who organized or sponsored an activity that resulted in a Public
Nuisance; and/or,
b. Persons engaging in activity resulting in a Public Nuisance; and/or,

c. Owners and Person(s)-In-Charge of the Nuisance Property; provided, however, that
the Owner of the Property shall not be held responsible for a violation and penalties if
the Owner is actively trying to evict an occupant from the Property and that the
occupant was the cause of the Public Nuisance.
F. Enforcement and Penalties.
1. Monetary Penalty. Monetary penalties may be imposed as specified in the penalty section
above.
2. Abatement. Action to abate a Public Nuisance may be taken by all reasonable means
available in law and in equity including but not limited to the issuance of an order by the
enforcing authority requiring the Public Nuisance to be corrected, issuance of a citation
by the enforcing authority, or through an order from a court of competent jurisdiction.
3. Each day or portion thereof that a violation of this Bylaw exists shall constitute a separate
violation. If more than 1 provision of this Bylaw is violated, each provision violated shall
constitute a separate violation.
4. The Town shall maintain on its website a list of nuisance property complaints including
dates and addresses, violations, and Town responses.
