One question in the case was the right of the defendant to dispute the plaintiff’s title. This Court, in holding that the defendant could show under the general issue that the plaintiff’s title had expired, said that though it is a common principle that the tenant cannot dispute the landlord’s title, yet, he is permitted to show that it has expired; and in so doing he does not dispute the title, but confesses and avoids it, by matter ex post facto. Holton v. Hassam,
