upon lots 163 and 164 in that part of Eden which had formerly belonged to and formed a part of the town of Belvidere. In the division of the public lands reserved in the charier of Belvidere, separate and distinct portions of lots 163 and 164 were set to the town school right and the Lamoille County Grammar School right, respectively. The selectmen of Belvidere, under the power given to them by statute to “lease” the same, executed a durable lease of the land set to the town school right to the defendant; and the Trustees of the Lamoille County Grammar School, to whom had been granted the public grammar school lands in Lamoille County, with authority “to lease” the same, executed a durable lease of the grammar school lands in those lots to the defendant. The defendant claimed the title to, and the right to possession of, the lands in suit by virtue of these leases. The leases were similar in form to the one in the instant case.
