464 charsThis duty, one of several set forth in the act as part of a landlord’s ongoing responsibility to maintain the leased premises, is a continuing one, and the act does not provide that it ceases when the tenant takes possession of the leased premises. Hence we agree with Errico that §' 34-18-22(2) created a duty that the LaMountains owed to her by operation of law and that this duty was in full force and effect when the railing on her apartment balcony collapsed.
