The defendant here has continued to pay rent in full and on time after being served with the notice to quit and has indicated her intention to do so regardless of claims she may have against the plaintiff in the future. There is no indication that she will be unable or unwilling to meet this obligation, and the plaintiff will not be forced to “repeatedly [forgo] what [are] clearly his rights under the lease . . . .” Id., 346.
