The defendant, Ray Vincent, doing business as Vincent’s Texaco, appeals from the decision of the workers’ compensation commissioner that the defendant violated General Statutes § 31-290a (a)1 by discharging his employee, Edward Loftus, the plaintiff, because of a workers’ compensation claim that arose in the course of his employment. The commissioner *68awarded the plaintiff “damages,” “out-of-pocket” costs and attorney’s fees.
